Blog 073: Incitement to Kill

In the quran we find incitements to violence which go so far as calling for the death of various groups: non-believers, women and homosexuals. These incitements to violence are distributed, read and taught in mosques and on the Internet. We constantly receive news reports of acts of Islamist violence, all of which are justiifed by sources in the quran, the hadiths and sharia law (See Annex).

Here are a few examples:

  • “And kill them wherever you overtake them and expel them from wherever they have expelled you, and fitnah is worse than killing. And do not fight them at al-Masjid al- Haram until they fight you there. But if they fight you, then kill them. Such is the recompense of the disbelievers.” Surah 2 verse 191
  • “Men are in charge of women by [right of] what Allah has given one over the other and what they spend [for maintenance] from their wealth. So righteous women are devoutly obedient, guarding in [the husband’s] absence what Allah would have them guard. But those [wives] from whom you fear arrogance – [first] advise them; [then if they persist], forsake them in bed; and [finally], strike them. […]” Surah 4 verse 34
  • “And [mention] Lot, when he said to his people, ‘Indeed, you commit such immorality as no one has preceded you with from among the worlds. Indeed, you approach men and obstruct the road and commit in your meetings [every] evil.’ And the answer of his people was not but they said, ‘Bring us the punishment of Allah , if you should be of the truthful.’ He said, ‘My Lord, support me against the corrupting people.’” Surah 29 verse 28-30

In Canada we live under a legal system where religion does not have precedence over legislation—or so we think. Think again. The preamble to the Canadian Constitution Act of 1982 recognizes “the supremacy of God” and provides for almost total freedom of belief and thought.[1] If a person is convinced that the prescriptions in the quran are right, that one can put to death anyone who defies one’s beliefs, then that person may take the liberty to do just that, given that such is the will of god and Canada recognizes the supremacy of god.

What freedom?

One person’s freedom stops at the point where it infringes on the freedom of others. However according to the Canadian Charter of Rights and Freedoms, religious freedom is protected and nothing expressly limits it. You will of course say that the Criminal Code must prevail and take precedence over the Charter. Let’s take a closer look. Here are some paragraphs of the Canadian Criminal Code:[2]

318 Every one who advocates or promotes genocide is guilty of an indictable offence and liable to imprisonment for a term not exceeding five years.

Yet woe to whoever would attempt to prosecute using paragraph 318, because that would require the consent of the Attorney-General.

319 Every one who, by communicating statements in any public place, incites hatred against any identifiable group where such incitement is likely to lead to a breach of the peace is guilty of:

  1. an indictable offence and is liable to imprisonment for a term not exceeding two years; or
  2. an offence punishable on summary conviction.

However, according to paragraph 319, no person shall be convicted of inciting hatred “if, in good faith, the person expressed or attempted to establish by an argument an opinion on a religious subject or an opinion based on a belief in a religious text;”

Thus, according to the Criminal Code, paragraph 319, we are led to understand that, under the guise of religion, believers, including Muslims, can legally incite hatred towards others who do not share their beliefs.

Currently, many representatives, imams and others, make declarations based on the subversive writings in the quran, thus resulting in incitements to direct violence. The fact that those who make such hateful statements can do so with total impunity leaves the field completely open to others to practice holy way. Authorities act surprised when Islamist suicide bombers, acting on the promise of the glory of martyrdom in a harem of virgins, blow themselves up in the name of Allah. The Criminal Code permits these incitements to religious violence, which constitute a homemade time bomb.

Caught in the trap

After recent events in Orlando, I felt really threatened. Although I am not a public figure and do not have a high profile, I am a non-believer, a miscreant who has written a book which denounces beliefs and I am active in various fora, including the organization Atheist Freethinkers. I occasionally receive threats from certain Internet users (usually Muslims) who do not like my objective and rational discourse.

Canada is a theistic country because it places religion above its laws. But Quebec never signed the Constitution Act of 1982; neither does it recognize the supremacy of god. Thus, it is the Quebec Charter of Human Rights and Freedoms which must prevail within the borders of Quebec.[3] If the Criminal Code of Canada violates the Quebec Charter, can a citizen of Quebec ask that his or her rights be respected by nullifying certain provisions of Canadian law which may be prejudicial to those rights? We must answer Yes, because we cannot accept the unacceptable. Indeed, paragraph 7 of the United Nations’ Universal Declaration of Human Rights[4] declares that all are equal before the law. Thus Canada violates the spirit of that paragraph by allowing religious Canadians to use their beliefs to commit crimes while evading prosecution.

I therefore went to the web site of the Quebec provincial police to lodge a complaint against the hateful declarations which we find in the quran and which may be adopted and taught. This complaint led me to call 9-1-1 and a police agent was sent to my home. This agent informed me that he could not submit a report because my insecurity was not caused by a particular event, hence not justified?!? Nevertheless, opponents of religions and innocent persons continue to be killed. In 2015 alone there were 2867 Islamist attacks in 53 countries in which 27653 people were killed and 26150 injured.

How can these be prevented? By identifying the causes: the quran, hadiths and sharia. Religious terroristes have invented nothing because they draw their hatred directly from these writings. An evolved and responsible society must not allow writings which promote crime to be distributed unimpeded. Furthermore, the argument of freedom of belief is neither acceptable nor defensible. Would we allow the extermination of Jews by Nazis to be promoted because it is a belief? Why should I accept that some people want me dead that my death is promoted by an explicit declaration in a billion copies of the quran?

We must therefore take the political path. However, with Trudeau II, we are in a situation even worse than with Harper. The latter was an evangelical and took some action against Islamists. But Trudeau is a muticulturalist and multi-religionist who allows beliefs to be expressed with complete freedom and without criticism or filter. So if it is impossible to change Canada, must we therefore work towards an independent and rationalist Québec?
